Imagine that you are working in the HR department of your company. You come across the following scenarios in which your input has been sought. Select one scenario from the two below and discuss the scenario of your choice and propose an action plan for management. You are free to discuss and analyze the two scenarios…it is you choice!

Scenario 1. A manager receives a request from a new employee to take off a Wednesday for religious reasons. The manager did not know that this employee was particularly religious and had given the day off to three other employees of the same faith when scheduling and cannot operate the business with any fewer employees on hand. Further, given the difficult economic times, the employer could not afford to shut the business for an extra day. The employee has told the employer that denying him the day off would constitute religious discrimination. What would be some arguments the employer could make in their favor and what other solutions could be recommended?

Scenario 2. A department is looking for an entry-level cashier. One of the job applicants is a cashier with 30 years of work experience. The department manager feels this candidate is overqualified for the job and is likely to be bored and leave the job in a short time. Instead, they want to pursue a candidate with 6 months of work experience who seems like a better fit for the position. Is such a consideration legal in determining the candidate’s eligibility relative to other applicants? What law(s) favor the applicant and what may the employer do, if anything, to select a more desirable candidate?
