PEERS POST:

Hello everyone.

The separation of powers separates the government into three branches that have different functions: legislative, judicial, and executive. The United States Constitution created a checks and balances system for the three branches of government so that no one branch would overpower the others. Both the separation of powers and checks and balances hold great importance to our democracy because both are fair ways to make sure that our government isn’t controlled by specific branch/group of people. This system prevents abuse of power, tyranny, and ensures freedom for all.

One recent real-world example of checks and balances is when the Senate voted to block President Biden’s Covid-19 vaccine mandate for private companies. This Senate decision impacted tons of small companies whose employee’s would be in danger of losing their jobs for refusing to be vaccinated against Covid-19 had they passed Biden’s vaccine mandate.

One recent real-world example of balance of power is President Biden needed congressional support to expand upon the The Affordable Cares Act. Improving and expanding The Affordable Cares Act was a huge part of Biden’s Presidential campaign promises. This Act provides low-cost, and/or free health insurance to individuals who aren’t covered under their employers, can’t afford to pay for private insurance, have preexisting conditions, or are in college and therefore can remain covered under their parent’s medical plans for the time being. Once elected as President, Biden needed the enough votes from Congress to expand upon this Act.

One recent real-world example of how the Constitution directly protects individuals and groups rights is the fundamental right for same-sex couples to be able to be married on the same terms as opposite-sex couples. Same-sex marriage rights are “covered under the Due Process Clause and the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution” (Wikipedia, 2022).
